Beard arrested?

Racehorse Haynes got one of the richest men in Texas Cullen Davis off a murder charge. Haynes would be great defending Beard, regardless of circumstances. Even if Haynes was alive and got Beard a "not guilty" acquittal, unfortunately UT and the public could not withstand the negative headwinds to fire Beard....

I don't know how anything gets decided in prosecuting.
USA today reports Police went to residence at 2:07 am on a " disturbance- urgent call
Local CBS reported police went to residence at 12: 15 am.
"On December 12, 2022, at approximately 12:15 a.m....

So did the police show up at 12:15 am or 2:07 am
Did Beards finance tell poliece when they got there Beard had choked her
Or had she left? And who then told the police it was no longer on going. And how did the police find Beard's fiance later, where?
The facts here are as muddled as the Paul Pelosi case.
No wonder police reports are considered hearsay.

Ultimately I don't think it's going to matter if the cops arrived at 12am or 2am. Neither of those are the police reports, right? That's USA Today and CBS asking someone? Surely if they both read the police report it would say single time and they'd report the same time.

I haven't read the police report, but thought I saw somewhere it was 4am when they arrived. :idk:

I think the 4am is when Beard was booked. Cops sent 2 to 4 hours looking around, talikng to Beard and Randi, writing it up, and driving him downtown.

Yes I can see reduced charges but did he choke her? Did he bite her? If that is true I dont care if its a misdemeanor or not. You can't have that representing the university. You just can't.

This. How can you have Beard as a leader of young men when he himself chokes and bites a woman? Best of luck explaining it as self defense since Beard doesn't seem to have any physical injuries. It's too high profile of a role for that. The court of public opinion would never let UT live it down.

Every now and then your values get tested. Sanctimony must give way to reality. What do you stand for?

Now is the time to prove it. Beard is not the program. It can be made whole with the right hire. Somebody very capable is out there who would love to move this thing forward.

We just have to believe in that.

For those with a magnifying glass, Anwar R posted this on twitter. It is the actual arrest affidavit. Again, not making a judgement but you can at least read what the officer reported.

Welp... there would have to be a major campaign to attack this account as a complete lie. If her physical wounds are true then he's cooked.

If he actually does have a recording...anyone recording conflicts with someone they aren't even married to is expecting the other person to be violent.

that's strange that he said that

He shouldn't have said it if the entire recording wasn't going to help. She may have been the primary aggressor but if he was the primary finisher then it won't look good if it's played in court in it's entirety. He was probably in a bit of a panic and didn't realize what he was doing to himself.

And you are correct about recording someone when expecting violence (or abuse). I had a long saga with my ex and I gained custody of my daughter when she recorded her mother screaming at her. Unfortunately, my daughter and I had to discuss what real evidence was in court and God Bless Her, she got that evidence.

Beard may have been doing just that but he should have left it at her aggression and gotten' the hell out of there.

I can't imagine Beard surviving this.

No one seems to care that we have a player with a DA charge right now (he's still cashing his 400K NIL deal). Nor did anyone care when Major banged an intern. Seems UT only cared when a female coached banged a player.

I was reading that when Tech screwed over Leach, he sued them but it never went to trial because a judge ruled that you can't sue the gov't. Heard that case is still active and Leach was still hoping it would get to Supreme Court at some point. I do remember the track coach suing, wonder the difference. If Beard is found innocent, and UT fires him, UT will have to pay the man and pay a new coach.

If he's found not guilty, then he should be our coach. period.

@Handler based on your last post I don't see how you disagree with my other post. Obviously if Beard is innocent of wrong doing, that changes everything.

However, simply getting a misdemeanor instead of a felony doesn't change anything opticswise, especially if he did in fact bite and/or choke his fiance. We will have to wait for hopefully the truth to come out.

Unusual relationship. "Together" for 6 years, and engaged for 3 years, but never married...?

After living with her boyfriend for a few years, one of my in-laws told said boyfriend to either sh!t or get off of the pot. They were engaged later that week and married within 6 months. A bit of a tangent, but there's a real life-time danger for women that stay with a man for years who won't marry them. They could age, "hit the wall", and get dumped. Then it's much more difficult to find a quality spouse. C'mon ladies, make the dude give you a ring after 2-3 years max, or send him packing!!! You don't get to rewind and get those years back.

12-24 months is the correct time for deciding on marriage according to what I read 25 years ago.

Handler,

Great view of completely different situations.

Major had an affair (supposedly brief) with a student over whom he had no authority. Was it criminal or an action between two consensual adults and God.

The track situation was a coach and a student athlete whom the coach had authority over. It was not "brief" and they lived together for a couple of years. Our goofy-*** administration chose to grab their cheeks rather than fight the lawsuit, which I am sure David Beck could have easily won. Settling that nuisance case was a travesty and misappropriation of University money.

The only thing the cases had in common was they both involved employees of the athletic department. Other than that, it is akin to comparing apples and anvils.

Concerning Beard's future and contract, I don't think he'd be foolish enough to sue UT. In the court of public opinion a wife abuser is pretty low on the totem pole. Money makes people do stupid things so I wouldn't rule it out. I suspect there would be some negotiation so he received something, but nowhere near the full buyout. If I had to guess, it'd be a pittance.

Just when I thought I'd seen every conceivable way for Texas to screw up a season, this happens. Unbelievable, really.

That says the 2 am hour, if it matters.

UT cared when the baseball coach (Gustafson) paid his son to run a summer camp, er I mean, gifted his son money to run a summer camp. They "didn't care" when a baseball coach was arrested for drinking and driving (Garrido). Assuming caring is fired and not caring is kept employed.

Beard has a future to protect. If he slinks away with no lawsuit then the court of public opinion convicts him. If he sues and the university chooses to go to trial (which would be hardball) then he risks his fiance spilling her guts on the stand. Weepy testimony is devastating.

It's a tough situation UNLESS she is lying.

But this is pure speculation on my part. Obviously, I wasn't there.

Driver,

I assure you they have had plenty of words FROM me. I would simply do two things:

1) Refer them to the incompetence existing in the president's office at that time

2) Ask where the candy truck is that I was promised over a decade ago. How long are we going to be held hostage?

Just speculating, CB may have said it's over, she flipped and caused these abrasions herself. Her dropping charges and admitting she lied would be the only way he salvages this.

If he continues to stay with someone like this then he deserves what happens. Before you jump to defend her, just google her and see what has happened at Frendship high school where she was a coach and also what Beard tried to get done with her at Tech.

Although rare, it has happened that a woman in such situations has inflicted such wounds as bruises and abrasions and then reported to the police that the wounds were inflicted by the spouse (or significant other).
I have no idea about the Beard case.

LC,

I liked Haynes, but if we're going to pull someone out of Greenwood, I'd go with his mentor Percy Foreman. Has there ever been a better defense than Percy defending Candy Mosler?
I remember Foreman on a late-night talk show talking about his approach to jury selection as it related to ethnicity. I never forgot his logic. The guy knew how to win.

The DeGuerin brothers of UT carry on the Foreman legacy in the firm. But there was and always will be only one Percy Foreman.

Chin,

If you have never read "The Candy Murder Case", do yourself a favor and get a copy. Percy at his finest and funniest. There was never any doubt who was guilty, the only question was could Percy get them off. Of course, the answer is "YES".

Most of book is trial transcript.
