Their argument is that a sufficient number of states have ratified it. But to reach this conclusion, you have to ignore states that have rescinded their ratification and ignore the ratification deadlines.

Considering the deadline was something like 40 years ago AND that ratification is usually a legislative vote...it's safe to say several did.

How much attention were you paying to each State in that window of time?
