I didn't mean to imply that it doesn't happen more to blacks than it does to whites. Blacks commit more crimes than whites, so cops (black and white) are more likely to pay attention to them, especially if they don't look particularly clean cut. As much as we hate to admit it, most people (black and white) pay closer attention to a group of young black men approaching their car in a mall parking lot than they would to a group of young white men. To deny that is lying to yourself. The first step in dealing with prejudice is to recogize that we all have prejudices. The next step is to cleanse yourself of such guilt by supporting Oba... just kidding.

That video is disturbing. It is quite clear who was out of control and irrational in that video, and it wasn't the guy who got tasered.

The fact that the Police department whitewashed isn't even the most disturbing part.

The most disturbing part is that a large proportion of citizens don't see anything wrong with the police abusing their power because they figure that whoever got tasered (or beaten down) must have deserved it, because the cops said so.
 
Well, regardless of what happened if the guy can't recite the alphabet & count how many fingers he has on his hand then the officer probably saved someone's life.
Maybe even Ced's.
 
Field sobriety tests are almost 100% subjective. An officer can claim somebody is impaired no matter how they do on the test, if he is inclined to.

I would never agree to take one, sober or not.
 
I had a friend that was arrested for DWI sitting in her car in a parking garage near 6th St. with the engine off. The key in the ignition supposedly demonstrated intent and was the reason she was arrested.
 
This story unfortunately has garnered over 1000 blogs on ESPN's website. I just read a couple of them without responding myself, and they are pretty much stating some of the same things we have been saying on this thread; the abuse of power by cops, the end of CB's Chicago career, the fact that CB's criminal history probably means he is guilty of all of these charges, the racial profiling, and of course, the Longhorn stupid jokes!
 
Some of you who are trying to defend these cops are only making them look more ridiculous. I love how the guy never gets specific in the affidavit about what Benson did that was perceived as a threat, only that he's very muscular and the cop was basically afraid of him. So now being black, drunk, and muscular on a boat is a crime.

Some of you are assuming that all the Benson defenders on this thread think Benson did nothing wrong. I don't think that's the case at all. If Benson was drunk (and I feel reasonably certain that he was) and driving a boat, then he deserved to get arrested for it. But at this point, it appears that Benson was merely drunk while sitting on a boat and put up some resistance to being arrested because he didn't understand what he had done wrong. Keep in mind also there is still no proof that there was any kind of physical altercation initiated by Benson; just the arresting cop saying Benson was a threat because he was a bigger.

Imagine a cop pulling up next to a parked car in a parking lot, giving a field sobriety test to the person sitting in the driver's seat, that person" failing" said sobriety test, and the cop arresting him or her for DWI, without knowing how long the car had been parked there or who had actually been driving before the car was parked there (assuming there was at least one other passenger). This is essentially the same situation.

I realize it is always technically a crime to be drunk in public. But that's not what Benson was charged with. He was charged with operating a boat while intoxicated. That implies a completely different set of circumstances.
 
all i know is that as a sooner, since73 has had more experience deciphering police reports than anyone. i bet he knows what he's talking about.

i got a boat so i can have cocktails on it, if the police came over to an anchored boat and harrassed them, then i say screw the cops by any means necessary.
 
If the boat was anchored (which I don't know if it was or not), then how could they arrest somebody for being the "operator" if he/she was drunk BUT NOT DRIVING AT THE TIME? Who's to say that the "operator" couldn't stop drinking and be sober by the time he/she "operates" the boat?
 
and BTW, APD does pull people over randomly in downtown area. There are actually DWI Enforcement Officers that focus on DWI's. I know various people who have been pulled over for <insert BS reason here>.

I myself was pulled over randomly 1 night going 25 in a 30 with traffic all around. I was in the far right lane, but the cop said I made an "unsafe" move to the right. I questioned him on how I could do such a thing. He got overly upset and began being a real terd. This kind of behavior is total BS by APD and it pisses me off that there is nobody or nothing to do about it.
 
TxStHorn- I don't know how courts have interpreted "operating" in the BWI context, but I do know how the BRA/LCRA interpret it. I have seen/known people who got arrested for BWI in the cases I outlined in my previous post.

Of course, knowing both agencies I would not be surprised to learn that the majority of the time they arrest and ticket for BWI when a boat is anchored the ultimate conviction is for a lesser offense and they were just harrassing the person and knew they would not be able to get a BWI conviction.
 
This is definitely not a slam-dunk case for the cops even thogh they may think it is. I am definitely leaning toward believing CB. After reading all of the excerpts of this story from both sides, I am even more suspicious of city of Austin and Travis county's law enforcement. I would be supporting the defendant in this situation, even it wasnt a fellow Longhorn.
