Yes, he can. The reason why is that it sounds like the dismissal sought is on procedural grounds (prosecutorial misconduct) rather than his actual innocence. Could he be innocent? I suppose. We'll see what the allegedly exculpatory evidence says.

In this specific instance, you ALSO have to remember that, in the eyes of the left and lib, the mere fact that someone's name APPEARS on a docket means they are guiltier than Ted Bundy.
