You may not, but the law does. It is not illegal to consume alcohol and drive in Texas. It's against the law to be intoxicated and drive.

Someone above posted "Not according to the law. You're either under 0.08 or you're not."

Just want to say it's not as clear-cut as that. You can still be charged and convicted of DUI even if your BAC is tested and is below 0.08, if the officer testifies that you were still impaired and the jury buys it. So merely being below 0.08 does not always get you off the hook.
