Probable overturning of Roe v Wade

if they continue to protest at the SCOTUS homes and then they follow through on protesting at Catholic churches, they will really light a fire under anyone that seems themselves as being Christian. Even if you happen to be that rare Catholic that supports abortion access, you are not going to like them protesting at your church. Especially if they start hurling the expletives and accusations that these protest usually involve.

I have a question for your legal brain. Do you take anything from Alito's references to other case law in the opinion? The cases that effectively legalized same sex marriage, removed laws against sodomy, etc.

I've read some weird things about Alito's involvement in some of the uber conservative circles of Catholicism. Think about some of the Hollywood dramatizations of them in the Dan Brown stories. I'm curious what a smart legal mind thinks.

Coach, there are a couple of things to unpack here. For starters, I don't just reject Roe and Casey, I reject the entire substantive due process doctrine (the idea that the due process clauses of the Fifth and Fourteenth Amendments create new substantive rights not listed in the Constitution) that supports them. The doctrine invites abuse of judicial power, and not only is it not supported by the text of the Constitution, it's in stark opposition to it. In fact, the very term "substantive due process" is as oxymoronic as "intelligent Sooner" or "smart Aggie." (You didn't think I could answer your question without an insult, did you?)

Accordingly, though I agree with the logic of Alto's lengthy analysis about how the right to an abortion isn't "fundamental" or "rooted in history," I reject the doctrine that makes such analysis necessary. That means I would not only overrule Roe, I'd overrule an assload of cases, including but not limited to Lawrence (invalidated sodomy laws), Griswold (invalidated laws against birth control), City of Chicago v. McDonald (held that state governments can't restrict the right to bear arms), and the due process component of Obergefell (nationally recognized same-sex marriage).

Having said that, Alito and the rest of the Court clearly disagree with me on that front, and he does explain convincingly why they view abortion differently than they view same-sex marriage or birth control. Specifically, abortion involves ending a life or at least a potential life, and that's pretty significant. There's at least arguably an innocent victim in an abortion whose interests a state should be allowed to consider and protect. There isn't in same-sex marriage or birth control, and it's ridiculous to ignore that distinction. It's big.

Having said that, do I see the potential for issues to arise regarding certain types of birth control that allow for conception but avoid implantation? Theoretically, yes if a state decided to get tangled up in that issue.

Do I think there's real potential for the Court to overturn Lawrence or Obergefell? No.

The logical fallacies and just flat-out lies abortion rights advocates pitch to divert attention away from what they defend is just incredible. There's really no issue quite like it.

I don't blame local police for not arresting people for violating federal law. I definitely do blame federal law enforcement officers for not doing it. It's their whole friggin job. Garland should be fired for this.

This is something I admit I don't know much about. What federal law enforcement should be arresting unlawful protest? FBI? Hahahahahaha! They are working for the Marxist revolution. You better find someone else.
