You want so badly to snark at some of us you ignore what is known about the case.
Read Bronco's post. He explained what has been reported on this case. If you have some new information that shows the POS was denied access to the Mexican consul when he was arrested now is the time to post it.
I asked JohnnyM HOW the police were supposed to know he was a mexican if he didn't tell them.
He hasn't answered. perhaps you can.
Did you want the police to ask his legal status?

Can You McBrett deny that killer got the same rights as any citizen?.
 
You guys don't understand my position at all. The man is guilty- he deserves to have been executed. He is essentially an American- but technically a Mexican.

What you don't get is- the value of due process. In this case it is a hindrance- in most cases it is an invaluable tool. However- it is heavily dependent on being observed in all cases, or it is weakened in all cases.

the issue about him being a Mexican didn't come up until 5 years AFTER he was convicted.
Until then he had lived and enjoyed the benefits of being an American citizen.
He was denied nothing to which an American citizen is entitled.

Do you the vile POS told the SA police he was a mexican when he was arrested OR told his attorney he was Mexican and they then refused him access to the Mexican consul?
 
I get it, I just disagree with your conclusion and a majority on the Supreme Court agrees with me.
 
I believe an American will be incarcerated or executed in a similar case someday in another country- and examples like this will help make that happen.

no it won't. this is a political issue and it will be forgotten. if a us citizen murders someone is another country, they should be executed, but most countries do not have the death penalty, they just have prisons that are worse than death. for what it is worth, americans get screwed overseas all the time, like the internet guy that got convicted of murder in honduras or amanda knox. countless others that do not get a 20/20 story made about them. this will not help or hurt anyone. we have the best justice system in the world, this guy had multiple appeals. he had been here since he was two. neither he nor his attorney brought up the mexican national argument and frankly, it would not have mattered anyway. even if the mexican consulate had been contacted, he would have been subject to the laws here, he still would have been tried, convicted and executed. the mexicans are a funny bunch, they preach human rights for their citizens that break in illegally here but are free to rape, kill and imprison those that come in illegally through their southern borders.
 
I agree with you mcbrett. Process trumps the outcome of any one single trial. In this case the violent criminal act committed couldn't be worse. But none of that protects innocent people. Due process actually protects innocent people, much more than guilty people.

mcbrett, this matter is just proof of why you are someone from 'the other side' with whom I can usually talk with on here. It is because while we don't always agree, I believe we generally hold the same values dear.
 
I agree with Due Process. However, there is a certain point where Due Process is abused. The amount of motions that his attorneys filed were countless. They were basically throwing crap at the wall hoping something would stick. He had more than enough represenation.

Contacting the Mexican Consulate would not have changed any facts or outcome of this situation.

I know as most international travelers do, if arrested abroad your first call is the US Embassy.

Having been in the States for as long as he was, I doubt very much he would have even considered, I doubt he even had any papers proving he was a Mexican citizen, contacting the Mexican Consulate.

I don't care what country you are a citizen of, you committ murder, you get the needle.
