Interesting debate. Throw the book at the guys that blow way over the legal limit. But, the guys you pull over for going 5 mph over the speed limit or have a broken tail light? It can be viewed as a witch hunt.

IMO, if they pull you over after 9 pm and you had a drink and they can smell it, you're going to the station. I recommend skipping both tests even if you've only "had a couple."

Scott is right. It's late at night, they smell beer on your breath, you're probably going to jail.
