Chris Simms rejects plea deal on weed charge

Prosecutor will blink. Chris can afford a great lawyer. And I don't think it's worth the DA's time to take this one to court. I also have to believe he wouldn't turn down the plea after counsel from his lawyer if the case wasn't full of holes.

Correct me if I am wrong, the charge is driving while impaired.

They have no BAC, no blood, just an opinon of a police officer and maybe a video with sound.

I have been in that situation, and the extra $10K that you have to spend is worth it. Basically, it is a negotiation and the DA is not even concerned about justice, just his conviction record. Of all the things wrong in this country this is one of those that really pisses me off. The DA is not concerned about right and wrong but of his own record and winning and losing.

I am not a big fan of Chris, but hey he is still a Longhorn and I wish him the best. Yes, I booed at Texas Stadium and will boo again when our quarterback is part of what 4 turnovers in consecutive possessions? Hell I was booing Applewhite in the first half against Washington. I was saying take the shirt off of Vince!!!!!!!
 
Obviously this is going to come down to a he said/he said situation, but If Simms was indeed smoking weed and driving, I have to agree with DVPMD on this. There is no reasonable excuse for doing that.

It's been a long time since I indulged, but I smoked a lot of weed in my day and I have no problem with others doing so, as long as they do it safely. Did I smoke and drive? Of course. Was I a dumbass for doing so? Of course.

As with alcohol, some people might be able to function better than others after smoking weed, but that doesn't justify getting behind the wheel of a vehicle after doing it. Hell, it's dangerous enough out there driving while sober.
 
I'm not even going to try to tell a bbs from Austin that smoking marijuana is wrong. But if he DID smoke then drove a car, that is VERY WRONG. And if he would have hurt one of my kids while driving impaired, I would have sliced open his gut and showed him his own entrails.
 
^^^^^ agreed!!! Driving while intoxicated on alcohol is a 1000 times worse than driving while stoned. Weed should be legal anyways...I don't partake but I know people who do and they can function just fine driving while ripped.
 
Rationalize all you like. If you are so bound to smoking herb, or drinking, that you cant do it, and not put yourself in a istuation that may possibly endanger other's lives, you have a problem.
 
No one should drive while under the influence. Period.

Having said that, I can't remember the last time I encountered someone on the road who appeared to be under the influence. It's definitely been several years which tells me the rigorous enforcement is working. However, hardly a day goes by that my defensive driving skills don't prevent an accident while the other driver is talking on their cell phone and not paying attention to their driving. I clearly remember three instances in the past week including once today. I'm not one for too much regulation, but it's time for everyone to hang up and drive, even if it takes a new law.

Driving while on powerful prescription meds
Driving while sleepy
Driving while talking on cell phone
Driving while texting

Can't we just all agree that none of the above should be done in general?
 
The texting while driving **** is one that particularly disturbs me. It has no place on the road. How can you pay attention looking down and typing on your phone? I see drivers do it every day and just shake my head and avoid them at all costs.
 
The difference is that pot is mind-altering...not as mind-altering as cocaine or heroine, but still mind-altering.

In this society I guess that's where the line is drawn (and alcohol is on the other side of that line) where mind-altering drugs are considered social vices.

Agree or disagree with the legal status of pot, but that's the reason it's illegal. This question wasn't decided over whether it may/may not cause more deaths than booze, or that it may/may not be more addictive, or that, at least superficially, may seem more/less dangerous to our health and well being. Pot's illegal because mind-altering drugs are considered a social ill. And by trying to argue the cost of fighting social ills..saying how much money we're wasting and where it can be better spent misses that point completely and talks past it.
 
If you want to know why alcohol and tobacco are legal and pot isn't, follow the money. Pot is too easy to do-it-yourself, or at least make it in a mom and pop fashion, so there isn't as much corporate money to be made in it. Not true for alcohol and tobacco. Sure, I can make better beer at home than Coors can, but I can't make it as cheaply, and I definitely can't make good or safe whiskey at a competitive price.

Never forget in this country that it's all about the profit potential.
 
Having worked with people that were high on Marijuana, I say no thanks, not on my team. Just as I don't want someone coming to the office drunk, I don't need someone stoned either. I need someone with a clear mind. The same goes for people on the road, I don't want someone driving next to me with a clouded head.

All I was saying early on was that when the DA offers a plea, that is saying it is not a slam dunk. There are holes in the states prosecution and I would guess this:

Chris is a professional athlete that has been drug tested his whole life, at least since 1999. If they do not have BAC or blood, just an opinion of a police officer on what Simms said, which I find it hard to believe that anybody would admit to a cop they smoked weed earlier in the day, I think Simms Lawyer is on high ground. He could disclose Simms past drug tests going back to what 1999 if he so chose. If Simms never tested positive as often as he has been tested is strong defensive evidence in my opinion. He has never been in any alcohol or drug issues in the past, looks like a very tough case for the DA. Fight the power Chris!!!!!!
