I'm also sure that Code Pink or another group has sent an openly gay person in there to attempt to join. If an openly gay person is turned away, then that also violates the law. You don't have to be hired and fired. Its enough to be denied access to the job because of your protected status.
 
Fondren, then why aren't there cases (maybe there are) of someone suing for descrimination in the State of California? As a millitary person crossing state boundaries you'd have a hard time claiming that the state law should override the federal law.

Everything you mention above is very real and i agree with a lot of it...but everything you state above has nothing to do with the military recruitment office besides the recruiting practices, which they don't even list as a reason they want them out of the city.

What you mention above is how the govt uses the military....if the great folks of that city want to use their rights to protest against our gov for how our gov uses our military then perfect...they have every right to do that and should do that and i have no problem with that...but to protest in the way they do and against the office of recruiting is.......moronic… and then to hide behind the absurdity of harassing the recruitment office by saying they are protesting the war is ridiculous. It proves to some that they only WANT the freedoms of this country….

The section about the military and freedom in my post was really a response to those who drape themselves in the flag, and who are saying bomb Berkeley, park a tank in the parking spot, etc. That's the type of stuff Chavez and China do. I just happened to use your quote to respond.

My response to the general topic was Berkeley is in their rights to force out the recruiters because of unlawful, dishonest, and discriminatory business practices. Whether they are also doing it because they disagree with Iraq is not important to me, though I disagree with Iraq as well. The "don't ask, don't tell" policy alone is enough to warrant the decision. As are the shady sales practices.

Their practices are akin to if you bought a new car from a dealership and they sent you a completely different and inferior car. Then when you complained, they said you already signed a contract and you have to take the POS they gave you. Its just wrong on so many levels and needs to be changed.
 
fraud? if a guy doesn't become one of the few and the proud, it's his own damn fault, not the marines.
