Another reason to not drink and drive....

as if there weren't enough good reason already..

"Austin Police Chief Art Acevedo has a plan to clamp down on drunken drivers during the upcoming Halloween weekend: a court-ordered blood test for motorists who say no to a Breathalyzer exam.

Acevedo said he is using the holiday to test his first "no refusal" operation and hopes to continue the program during times when police typically see increases in drunken driving arrests, including New Year's Eve and Fourth of July."

makes sense to me. they have probable cause that you have committed a crime. that gives them the right to get a warrant to obtain further evidence. in this case, it is your blood. why is that different than seizing your bank records, phone logs, anything else?
 
I am against Drunk Driving as much if not more than the next guy, but this is scary from the legal side to me. What do I expect in a city that won't let grown adults congregated on public property smoke though?

i would definitely be against random blood draws. that is not this. this is only once you ALREADY have displayed probable cause that you are committing an offense.

if there was probable cause someone was involved in a terrorist plot, does anyone really not want that person's phone tapped?

wtf about my civil liberties to drive on roads without drunk-*** losers?
 
anyone convicted of dui/dwi should be given a mandatory conviction of attempted manslaughter. no questions asked, no soul-less DWI lawyers
 
i guess you would be ok with officers coming by for a "safety" check at your house. Got to make sure those batteries in your smoke detector are operational

If you have operational batteries, you have nothing to fear.
 
There are much more serious issues than drinking and driving but since it is such a "feel good" issue it is an easy to issue to exploit abuses with.

News Flash! A man who has three drinks and gets behind the wheel is not a mass murderer, in most locales anyway.
 
I'm against this too, but they're not holding you down and forcibly taking your blood. They'll explain the law to you and ask you to sit while they draw blood. If you refuse, they take you to lock up.

Dumb law, but I don't think it needs to be dramatized.
 
They'll take you to lock up if you refuse the breathalyzer. Actually, alcohol on breath is probable cause. That's my problem with it. You're also legally drunk after 3 beers in two hours. Are you actually drunk though? Seriously?
 
ba, I think you're right. You don't have a choice, you can say "not until my lawyer gets here," but I don't know what they would do then. And, if they draw under the legal limit, would they lie? Geez, that last line made me sound like Alex Jones.
 
For those comparing it with warrants....one striking difference, imo; is that in order to obtain a warrant, the law officers must go to a judge with evidence and get approval for a warrant. In the situation outlined in this thread, it sounds like the officers get to make their own judgement call as soon as they pull you over. Big Difference.
 
Does anyone know who will be drawing the blood for these tests? Will it be the arresting officers? What level of training do they have to do this? I can imagine the resulting lawsuits against CoA, APD, Travis county, etc. the first time some cop attempting to draw blood punctures a suspect's vein trying to draw blood.

Horrible idea. And don't think that this will only be done during the peak times like NYE & Halloween.
 
And I'm certain that we have absolutely no fear whatsoever of them warehousing the DNA data in some massive database, right?
