Was Zimmerman Under Arrest?

Perhaps some of the attorneys might be able to shed light on this.
It's clear from the video, Zimmerman is handcuffed when being led into the police station. Is it customary to treat suspects in the manner Zimmerman was treated after being involved in a murder.

It's my understanding that in Florida if one is handcuffed, brought to the police station and blows a 0.00, he/she must still be arrested as part of the process.

If it turns out that Zimmerman avoided a legal arrest, unless he is charged within a 175 day window, the state of Florida cannot charge him with the Martin murder.

Not a lawyer type, but farly certain there is no statute of limitation on murder. There is no double jeopardy though. As this investigation continues, my guess is he will be indicted and face a jury.

Also, I think it is common procedure to handcuff anyone suspected of a crime when transported for the police officer's safety.

No Zimmerma was not arrested, when they are suspects and transported by the Police, they are handcuffed.

There is no statue of limitations on murder in Florida.

I don't think the charge will be murder in this case.

This is according to a former Florida prosecutor. If he was under arrest, he has to be charged within 175 days of the arrest. I didn't say anything about a trial - speedy or otherwise.

Quote:
The law of the State of Florida gives the State Attorney this type of discretion and they can subpoena these witnesses to come to court even if they should indicate that they do not want to. Nevertheless, the prosecutor must file formal charges within 90 days of your arrest if a misdemeanor offense, or 175 days of your arrest if a felony offense. Otherwise, the State Attorney is forbidden from pursuing charges against you after the expiration of that period.

FL has a special prosecutor looking into this. I've seen interviews with the family's attorney that they are now satisfied with how the investigation is proceeding. Maybe he doesn't represent the family's views and his comments have since been amended, but I think the State of FL is going to get to the bottom of this.

He was NOT arrested. When he is formally charged and arrested the clock starts. There is no Statue of Limitations on when they arrest him. They could arrest him 20 years from now.
