So I used to work for a small bank as a teller. But yesterday one of the vice presidents came and told me that I either had to resign or I was fired. So I resigned. However, I do not feel like they gave me a very good reason for their decision. So I was hoping that someone could help me out a little bit.
I was told that I was getting fired for looking at other employees account (you can't even see their balances or anything). They claimed they have a "zero tolerance policy" on this that is in our online usage agreement but no one has ever seen it there. There were 3 main employees that I was looking at their accounts. One of them is my fiance and I'm not a signer on her account or the car loan she has at the bank. I do however have a joint account with her at the bank we use for all of our banking. The joint account is where the loan is paid from and I often check the account at work to make sure that the payment got in and there hasn't been anything happen to it. I guess I'm just paranoid about a late charge.
The 2nd employee is our receptionist. She has 3 daughters and is a signer on all of their accounts. One of her daughters came in quit often to make a deposit or withdrawal, get her balance, or see if something has already been taken out of the account. So every time I pull up her account it says that I'm looking at the receptionist accounts.
The 3rd was a former teller that worked with me and I often did transactions for her whether it was a deposit, withdrawal, or cashing a check. They aren't as worried about it showing that I looked at her account since they know she did transactions.
All of this is from back in August and September. They said they got a random periodical report that showed that I had been looking at these accounts. I don't know how often they get this report but I would think they have access to it whenever they want. But this was the only reason they gave me for forcing me to resign.
Today I drove by the bank and the daughter of the vp who forced me to resign was working at my former window. She has previously worked at the bank but quit in November I think. She then came back to work much fewer hours but made it very well known that she wanted more hours, especially lately. I work the exact number of hours that she used to work and wanted again. There were 3 other tellers hired since I have been so they couldn't have laid me off.
Another thing is that they claim there is a zero tolerance policy for coming in late yet one of the other tellers who has been as much as 2 hours late before on a saturday morning was not fired.
So I'm just wondering if this sounds like a legitimate firing or not? Is there anything I can do about it because it's going to be very hard to find a new job soon? Thanks for any help you can give me.
 
a similar thing happened to me a few years ago...i started working for albertsons as a sacker when i turned 16 and by the time i was 19 I was a front end supervisor...youngest in the DFW division...anyway, after about 2 more years there I got framed for $800 missing from the store safe (i handled the safe whenever i worked). I knew how to do their paperwork really well and rarely if ever made mistakes. So I went through every piece of paperwork I had from that night and several nights prior, finding nothing missing or wrong. I did however, find $800 missing out of several of the self-checkouts from a day that I didnt work...yet they said it was my fault...they told me I couldnt work on the front end anymore and would have to move to a different department...basically become a stocker, making considerably less money...

I said **** em...and left...

now I have a badass job...worked out in the end...

I found out later they were making up **** about a lot of the long time employees there, because they could hire a new person and pay them much less...
 
Illegal? No. ******? Yes. If you could find someone to take your termination case in a lawsuit, you'd probably lose. And even if you won, you wouldn't get enough money out of it.
 
The 2nd two accounts you "viewed" sound like bull, but they CAN get you for looking at your fiance's- even if it's unreasonable.

It sucks, but I don't think there's anything you can do about it.

I worked at a Homewood Suites (Irving, TX) in the evenings while I was a stay-at-home dad and was canned because I refused to work graveyard shift and couldn't learn the processes after a 1 night crash course. The management at the hotel were idiots and I was glad to not be associated with them after they dismissed me. It was bs basically and they ended up getting theirs in the end when their shady accounting practices were brought to light by their marketing person. I'm back in Austin now and loving it!!!

Since you are an At-Will employee they really don't even need a reason. I think Montana is the only state where you have a few rights, and unless they fired you based on race/religion/gender or because of a few other reasons (like you got fired for jury duty) then you have no recourse.
 
I think that dogbert was trying to say, "Employees can be fired for...umm...any reason. Yeah that's the ticket!” This is to say that employers will make up a reason if they don't already have one. I'm pretty sure that this is a failsafe method that is used around the globe. Unless the employee has something saved on the employers or enough employees whom are willing to jeopardize their own jobs by standing up, you have little recourse. I would imagine that the OP would have a hard time getting an ATTY to take hs money on this one and that says a lot.
 
With you not letting them fire you you can not receive unemployment. Firings from a teller position would not come back and haunt you in looking for a future job. Either way when you resign future employers will ask you why and if you are fired they will ask you why... at that point it becomes your integrity that is on the line. I don't think anything you did was wrong or justifiable for a firing... but the boss gets to do as he will in most cases...

However now you don't get to live off of the government and my taxes... so for that... Thanks!
