Loftin said earlier in Sept he expected $12M but we may have to wait and see how much WVU and TCU have to pay the Big East to start in 2012.

Great irony would be to let A&M pay the Big East exit fee amount to bring on the new members.

Including legal fees!!!
 
The potential loss of TV revenue for a 9 team conference has been quoted to be in the $30 million range. With aggy and Missouri both leave the estimated shortfall in TV revenue was $60 million. With TCU and WVU (who brought suit in state court today against the Big East) on board, the full $60 million is probably off the board. If WVU loses its court case, $30 million could be back on the table.

$20 million was the calculated exit fee and look for the B12 to hold to that. aggy and Missouri probably would then sue - no basis other than CU and Nebraska were not forced to pay the entire penalty.

Moral of the story - be the first to leave, not the last.
 
I am unclear on a few things, if someone in the know can help out.

The bylaws of the Big 12 state what the exit fee will be, correct?

The bylaws are not legally clear as to what years of TV revenue will be subject to exit fee accessment, correct? Seems I read this was the case somewhere.

The exits of CU and NU did not change the TV contracts, correct?

What minimum # of teams are the TV contracts based on, 9 or 10?

Did the exit of TAMU in and of itself put the TV contracts in jeopardy?

Does the exit of Mizzou put the TV contracts in jeopardy? MU has not officially left the B12 yet, have they?

Depending on the answers to these questions, the CU and NU exit fee negotiation may or may not be relevant. If the minimum team number if 10, TAMU leaving upset the TV contract and might be the basis of a suit for damages. If the magic number is 9 teams, TAMU's exit should only be subject to the exit fee. I suspect it will be negotiated down from the "full" amount but if I were the B12, I would take it to court. Mizzou would have the onus of the exit fee and potentially damages due to "breaking" the TV contracts.

Some have said that by adding TCU and WVU, damages are mitigated because the number of teams meets the contract requirements but some would argue that the value of the contracts is reduced due to a smaller fanbase resulting from having to replace TAMU and MU TV watchers with fewer TCU and WVU watchers. If the contracts don't specify which teams or define the TV footprint, it seems to be no issue but if specific teams are listed, ESPN might have a legit beef with the conference and the conference would have an argument for damages.

I am not a legal expert, just a curious fan. My gut tells me that the exit fees will be negotiated and all will go quietly into the night.

I have not even coinsidered the aspect of using the exit fees to pay the Big East exit fees. With the increases in revenues and stability that TCU and WVU will gain, I think they ought to pay their own way. They were not part of the conference when the TAMU and NU exit fees were "earned' by the remaining conference members so they should not expect a share but sharing may be the price the B12 pays to remain intact at 10 members.

Nebraska and Colorado got off easy. The Big 12, if it is truly trying to stay alive (and I am someone who wishes it wouldn't), needs to assert itself and show that its not going to be pushed around. They need to send a message to any other members that might be looking fondly at greener pastures and to other conferences that might be looking at its membership.

Of all the schools that would be hurt the most by a breakup of the Big 12, it would be Baylor. I suspect Starr both wants and needs to make an example of A&M to deter OU/OSU and Texas from casting wandering eyes in the future, and also signal to Mizzou how much it will cost them if they want to follow in A&M's footsteps.
 
I certainly see no reason to negotiate the exit fee downward, and I'm thinking this committee of three impartial arbiters may not either.
 
I think a school should pay an exit fee based on what they are worth. In this case, aggy should have to pay nothing.

In fact, I am not opposed to paying them "to leave."

In a couple of years, the SEC will be wanting to pay us to take them back.
 
I think the current situation is worse for Missouri. With the lawsuit filed by West Virginia, it's pretty obvious Missouri isn't leaving next year. The Big 12 needs ten members to avoid a renegotiation of its TV contract. Until West Virginia is cleared to enter the Big 12, Missouri has a ton of legal trouble.
 
I think they should charge an exit fee combined with paying back the money with interest on the exit fees they collected from last years Neb and CU defections. I want them to leave, but the Big XII should make it as difficult as possible for any of us to leave to ensure stability.

Oh, and I think we should broadcast those meetings pertaining to aggy exit fees on the LHN for good measure.
 
Four schools were going to get murdered if the Big 12 died and all of them except Iowa State are on the committee. Why did the Clones get left out of the fun?

I think the number from the Big12 bylaws for max exit fee by leaving without full notice would be $28M.

Whatever was discussed w/Beebe will be revised with the 3 man commitee.

The Big12 is probably holding $20M for A&M this season depending on bowls and BCS. Loftin tossed out $12M during the early season.

My guess is an agreed $15M and mutual releases. Same for Mizzo if WVU starts July 2012.

Why Pecos? If they're holding $20 Mil, then drop their fee to $20 Mil. Makes it simple, & they should be charged every cent that is easily collected up to the full $28 Mil.
