The Senate's Utter Scorn for the 4th amendment ...

I'm with you on this one, BI. I cannot fathom why the government should need a warrant to search my mail, but not my email.

I've heard it argued that sending an email puts your information out of your control, and thus you don't have an expectation of privacy. But isn't that the modern equivalent of putting an envelope into the hands of a postal employee? Passwords on email accounts are analogous to envelopes, keeping the contents of the communication private.

This isn't something I lose sleep over because there isn't anything in my emails the government would care about. But that doesn't keep me from recognizing that this area of the law has spiraled way out of control.
 
Virtually no Republicans care about the 4th Amendment. A few Democrats care about it, but most Democrats only care about it when a Republican is in the White House. When a Democrat is there, they don't give two squirts of piss about it.

This is why you need a Supreme Court that will enforce the 4th Amendment and apply a strict exclusionary rule (the idea that evidence illegally obtained or analyzed is not admissible).
