Tax seizure; now refund...

Sorry. Wasn't sure how to title this.

I had my tax refund and stimulus check seized incorrectly by the Child Support Dept. here in TN. In May, I went before a judge where it was deemed that - rather than arrears as the State had me - I had actually overpaid my child support since 2000.

The refund checks were being held by the State. They are now to be refunded back to me. Does anyone know the process by which this occurs? It's been two months now. The Child Support Office told me in early June that they'd released the checks. I'm assuming that the money was sent back to the IRS to be reissued and I must wait as if I just filed my tax taxes. Any advice?
 
It seems the best course of action would be to contact the IRS with proof (letter from Child Support Office) that you are owed the money and have them void any previous payment and issue a new check.

Is there something I'm missing?
 
I would think that the funds having been siezed already would be sent to you by the agency that seized the funds. Refunding to the IRS, then having the IRS reissue a check does not seem to be logical in the least.

What happened is that the child support office never got the most current court order. (My original amount was based on an 80-hour work-week I had at the time - newest order calculated on 40-hour work-week.) Therefore, for years, they had me in arrears as I battled and battled them. Finally got in front of a judge whom sided with me.

The ironic thing is that I have my daughter over half the time anyway. However, I'm afraid of my ex's response were I to ask my child support "obligation" to cease. She'd make me and my daughter's life a living hell -- so, I just pay the money.
