long story short. went to a bar with my gf and friend. the owner of the bar was there drinking heavily. the waitress at the bar has some personal vendetta against my gf. we are leaving the bar and the waitress and owner attacked my gf. my gf, friend, and me get arrested for public intoxication. the owner of the bar and the waitress get off scott free. do i have any legal grounds here?

Why would this be a TABC issue? You aren't providing enough detail in your quest to make a long story short for anybody to really answer your question with any authority.

can the licensee of the establishment (the owner) be drunk on the premises and make business decisions. and do the owner and waitress have the right to attack customers? im just hoping that someone who knows a little bit more than me about tabc law, can confirm that the owner/ licensee cant do that.

A Licensee can lose their license for being intoxicated on premise or for even being cited/arrested for ANY alcohol convictions.

The TABC frowns on this big time.

You could try and file assault charges on the owner. When the license comes up for renewal (regardless of the outcome) the citation will show up under that address.

thanks that's what i was thinking. the waitress physically attacked my gf and then the drunk owner jumped in and got a few in on my gf too. we already filed assault charges and i plan on filing a complaint to tabc today. oh and there was no nose beeping....but i should have beeped a damn nose!

I can (confidently) confirm that an owner who is inbibing while alcohol is being served is a BIG NO-NO.
However, you're in the realm of allegations... TABC has to witness the event, I believe.

i have a friend who is a bartender at that bar. he told me that the bar records audio and video. would tabc be able to look at the video? he also told me that they have to log any incident that takes place in the bar. he read what the owner logged and it was completely false. but i think you might be right that an officer has to see it happen. from what i hear tabc has been called on her before for the same thing and nothing has ever happened to her.
