I got a call on my cell phone (which is on the do not call list) from Statewide Civil Process Inc. Informing me of pending civil action against me in Montgomery County. This raised a red flag since I haven't been to Montgomery county. Nor have I been anywhere near Dallas for that matter in years! So I googled the number they provided me with to resolve the lawsuit and avoid having to appear in court and this is what I found.

"Caller ID listed caller as United Abstract (631-755-3085) - caller identified himself as representing my county and said the court was issuing a summons against me - please call (888-855-0751) Jacobs & Klein before 1 p.m. to halt the summons processing. This is a collection agency scam - they give just enough information to appear legitimate and say they can remove negative reports from your credit report if you agree to a settlement on a debt - will you pay this debt with a credit card or a wire transfer. Get their call back number or fax number. Contact your attorney who will verify there are no summons waiting to be served - notify the credit bureau of this fraudulent activity - then post warnings to others"

My question is what do you recommend I do? Is there someone I can report this to? Or tell them my lawyer will be handling this for me and that we will see them in court (Obviously just to scare them)?
 
You can tell a collection agency all day long that you're contacting your lawyer, and they'll just laugh at you. You have to tell them that your lawyer has requested all further communication go through him and give them contact info. When they confirm you really have a lawyer they'll leave you alone.
 
I retuned the call just to see what they would say. Specifically, I asked who filed the lawsuit and what the charge was, but they said they needed the last 4 of my social and date of birth. And I said bull ****, I have the right to know who has filed a suit against me and hung up after he gave some **** about not being able to release that info because of 3rd party rules.

Just as an fyi Statewide referred me to Foster and Freedman the "Law Firm" that I called and got this BS from.
 
Is this a consumer debt? Tell them it's a DTPA violation to sue you on a consumer debt in any county other than where you reside.

Actually, don't tell them ****. If you get served with a suit, counterclaim for DTPA.
 
I have no outstanding debt. So It would be pretty interesting if I get something in the mail.
 
I would contact the consumer protection division of the Texas atty general. This is a DTPA violation and probably a crime.
