Should this teacher get canned?

People are terminated all the time for bringing bad publicity or embarrassment to an employer.
 
No. She did something completely legal before she started teaching. It has nothing to do with her qualifications for the position. I think it is a more interesting call if she did porn, but she merely posed for nude pictures.
 
was there a question about this in the interview process? seriously it doesn't seem like it was that hard to do a Google search and find a bunch of her pictures. Thus if they didn't do their due diligence prior to hiring her and she didn't hide it from them, I don't see how they can fire her for something that she did prior to employment and didn't hide from them in the interview process.

That being said, she will likely resign at some point as how can you teach Spanish to a bunch of horny 14-18 year old boys that have actual pictures of you naked?
 
She did this before she applied, was interviewed or hired. If the district didn't do their due diligence before hiring her then that's on them. A simple google search of her name brings up plenty to make a decision.

Now, with that said, if I were 16 yrs old in her classroom I'd have some bad thoughts and be unable to clearly think. I don't think she's good for the classroom, but I don't think the district has the right to can her either.
 
I tend to agree with Roger and Larry. If they never asked if she had done this sort of thing or looked into it, then I don't see any basis to fire her.

If they had looked into it and discovered it before she was hired, then I think it would be valid reason not to hire her. I guarantee you that every guy in that class has googled her to"check out the goods." I can also assure you that they aren't going to be thinking about Spanish much during class and will do everything they can to get detention. It doesn't take a genius to know that environment won't be conducive to learning Spanish.
 
Having taken high school Spanish once upon a time, I think she might be better than many teachers ...
 
The hiring agreement normally states that this type of conduct is grounds for termination.
 
16 year old boys would be picturing her naked anyway.

I think she needs a good paddling.

would the contract/ agreement she signed have said IF she did anything in the past?
I can see that a school would have a morals clause while employed . but if it was stated that if she ever, in her past did anything then surely they would have asked her?

If it is that big of an issue, they should add something to the contract about legal but unacceptable behavior that occured PRIOR to taking the job. But, that gets into employment law and Im not sure if it would be allowed.

What if a teacher makes a video with her BF and it ends up all over the internet after they break up? She obviously didnt want it there, but it has the same situation as far as kids in the class.
 
I glanced at the teacher articles of ethics mentioned in the article. It does not appear to apply to past conduct. I actually am at somewhat of a loss to see how this is a big deal especially since it was past behavior.
 
Here's an idea -- make her the honors Spanish teacher. You can only get in her class if you get an A the year before. To stay in the class, you have to keep getting A's. Now that's what I call motivation.
 
Her case should follow the rules. What are the rules for nude modeling for a teacher? Is there an exception if the modeling took place before employment? This can't be the first time this has happened.
 
I'm guessing it was the parents. Or maybe she was a crappy teacher and this was a good excuse.

As a new teacher, she was on a probationary contract. This means that they can get rid of her at the end of the year for any non-discriminatory reason. They don't even have to give a reason. They should have waited until the end of the year and just not renewed her contract. The lawyer bills would be a lot cheaper.
