Roofing company wont honor warranty

about 12 years ago we got a super premium 30K shake roof intalled on our home. The company touted the warranty up and down as a selling point and justification for a slightly higher price.

Long story short is now that we need some very minor repairs ( half a dozen shingles have fallen off. they wont return our calls. we have been trying for 6 months now and they return our call when we use a new phone number (ie work or a friends cell) but as soon as they find out we are inquiring about warranty work they get rid of us and that number is ignored from then on.

The roof is starting to leak so i dont have time to dick around. The work would only cost 4 or 500 bucks in my very rough estimate. Do I just get someone else to do it and take them to small claims ct. do i need to hire a lawyer? Would hiring another company void my claims for future warranty work?

any advice is appreciated
 
The BBB and your local attorney general are your friends on this.

You could have it repaired, then bill the roofing company I suppose.
 
The BBB is about as toothless as the UN. They are basically a reporting agency. The do have a mediation/resolution center, but few people bother to check a BBB rating before using a company. If you see a company sporting a BBB logo, they do usually have a good rating.
Having said that, yes, do file a report with the BBB for others to have for future reference. It likely won't help your situation, though.
 
If you have others do the work, it will likely void the warranty (or at least that is what the company will claim). Your retort would be that you have tried (unsuccessfully) for 6 months to have this company come out and do the work. You do need to check your warranty to see exactly what it covers.

Some cities have bonds that may cover you in this situation. I think small claims court may be your best bet because I have a strong suspicion that this company is insolvent or about to be insolvent. It may be worth it to have an attorney write a letter, but I do not think it would be cost effective to have one file a lawsuit on an hourly basis and I sort of doubt one would take it on a contingency. My concern is that you pay for an uncollectible judgment.
 
Since you said "Shake" roof & a $ 30,000.00 price tag, I will assume you are not in the Austin area.

Follow up on this info & then we can go from there.

My 1st line of suggestion is going to be a certified letter to them stating your issue, include a photo or three, then explain how you will use all the "social media" options that are available such as Yelp, CraigsList & places like HF to put their name out in a negative light (plus report it to the BBB).

Social media & getting a bad rep is usually the thing that gets a company moving when all else such as you have tried won't work.
