I have a temp. orders in a divorce set for 2/11 against a very well accomplished lawyer. she wants to get in to my client's cell phone calls/records. instead of serving me with a RFP, she did a subpoena duces tecum for my client, the respondent, ordering her to bring the records to court.
1. i see this as an end run against discovery rules.
2. I know that I MUST file a motion to quash.
3. shouldn't I ask for sanctions, at least asking for attorney fees to be paid by petitioner, with respect to the work done getting this quashed
