To overturn Obamacare, what is needed?

60 Senate votes for Cloture.
51 Senate votes for overturning.
218 House votes for overturning.
President's Signature.

I predict the end of Obamacare on Tuesday, Jan. 22nd, 2013.

If the Republicans take 6-7 Senate seats and the Presidency, Congress will have the repeal waiting for Romney on 1/22/2013.

This election is going to be real hot and heavy, it just intensified by about 1000!!!!!
 
Concur Bevo. I don't see the Repubs getting 60 senators, so we'll have the "non-filibuster" filibuster and other procedural roadblocks. Then the compromise will be to "fix the law."

Is there a good site/source on what's really buried in that several thousand page law (i.e. 1% financial transaction tax, new powers for unrelated parts of the bureaucracy, etc.)?

House will vote to over turn in August but nothing will happen until Obama is gone and the Senate numbers change... so 2013 best case.
 
I wasn't asking your opinion if it would or not be repealed, I was asking what is needed, but thanks for your educated input.

I think the 60 for cloture would come out in the election. There are a number of moderate democrats that would put that number over the top. If Romney does win, the House holds steady and the Republicans pick up 6-7 seats, that would be a sweeping victory and some Dems would jump on the board early during the honeymoon phase.

Just my guess, if Romney does win.
 
You can kill the tax provisions with 51 votes via reconciliation. With control of the senate, you can put surviving D senators on record as having voted for massive tax increases. I think it will be overturned and new legislation put in its place IF you get an R president, senate and house.
 
Since it is now considered a tax, and all taxes must be generated from the HoR, will this be revisited or taken through the courts again because of the unconstitutionality of the process?
 
Obviously, Romney has to win, and they have to hold the House to repeal Obamacare. The wildcard is the Senate. I think they would need to pickup at least 7 Senate seats to invoke cloture. That would take them to 54 seats. Who would the six Democrats be? Kay Hagan (North Carolina), Tim Johnson (South Dakota), Mary Landrieu (Louisiana), Mark Pryor (Arkansas), Mark Begich (Alaska), Joe Manchin (West Virginia), assuming he's reelected. If they don't get to 54, it's not likely to happen.

(And despite his whining about the filibuster rules, don't expect Reid to be on board with "reforming" the filibuster if Democrats lose the Senate.)
 
Obama proposes fanciful budgets which are voted down almost unanimously in the House and Senate. The House has proposed budgets which die in the Senate. So, to an extent the problem is in the Congress, but to be specific, the Senate.
