My story on Credit Repair

i am not going to argue with you about it. believe what you will. i just went through a huge lawsuit brought by the FTC against one of my clients who is a credit repair company.

it is the FTC's position that CROA (the Credit Repair Organization Act) prohibits a person from disputing accurate information on their credit report. if you know it to be accurate, you can not dispute it for its accuracy. credit bureaus will not just dispute an item for the heck of it. you have to believe something is inaccurate about it and ask them to verify it. if you know it is accurate but you want it off because it is negative, you can not legally have it disputed. it is that simple.

in practice, do people claim they believe it is inaccurate just to dispute a negative item? absolutely. does it work? absolutely.

does disputing an item restart or change the last activity date? absolutely not. and if they are changing it, they are violating the Federal Fair Debt Collections Act. the last activity date has to do with payments and only payments. it does not have anything to do with disputes.

i believe someone else already quoted it but here is the relevant portion of CROA which prohibits a person from making a misrepresentation to a credit bureau (ie...claiming an accurate item is inaccurate just for the sake of having the credit bureau verify it)

I for one ( and with good credit) dont want people who dont pay their bills to be able to repair their credit. I want the these peoples credit reports to be accurate, but also to reflect their credit risk to me as a potential lender or landlord.
If you don't pay your bills, then thats a tough lesson for you to learn the consequences.
 
i agree that people that are habitual credit abusers should reap what they sow, but keep in mind that a few months of unemployment and not paying bills can erase years and years of good credit history and take you from a 700 to a 500 score quickly. then it takes years and years to build it back up. does that seem fair?
 
Why shouldn't it be fair if the rest of us/them have to play by the same rules?

Do you not think that someone who never was unemployed for a few months and failed to play bills is more credit worthy than the opposite?
 
If I run a light and get sent a ticket in the mail, I don't send 8 letters disputing the fact and try to get off of it. I pay the for my poor decision. But **** it, I guess I was unethical in going through the light. Haha
