Legal advice on a Class A Misdemeanor *DELETED*

with no visible marks and no statement/testimony from your wife about any pain, there is basically zero chance they will even try to prosecute you for a class A misdemeanor.

pretty slick move waking your wife up with your hand around her throat, esp with other people in the house. if she decided she wanted to say it hurt when you did that, very good chance you would get a class A conviction.

EDIT to add: I am assuming tomorrow is a pretrial conference day, not an actual trial date. You will meet with the judge/prosecutor. Be honest and forthright, and tell them you know that for a class A there has to be injury or a claim of pain, and there is none in this case, so you are absolutely not guilty.
 
TRIAL date or COURT date? Very important difference. Generally there is going to be a pretrial conference first, at which time this could be resolved. If the prosecutors are actually going to take this to trial (which would be very surprising), you need to be sure your wife is prepared to testify, and I would recommend you get an attorney.
 
You need to hire a lawyer is what you need to do. your "plan" about taking the police report in and explaining **** to them is about the worst idea you could have. They already have or will have the report. this is not some shocking "new information" for them.

Additionally, you do not need to be speaking with anyone drawing a paycheck from the State of texas about this matter ever again.

Sorry for sounding harsh, but you post that you are "horrified" to learn of the serious nature of the charge against you. your response to the horror is to come here seeking advice.

You "get" how serious this is, and i am just stating that you should do what someone taking this issue seriously WOULD do, which is to hire an attorney.
 
BurntBlood - I recommend taking the advice above and getting yourself some legal represetation (get a lawyer). Second, I wouldn't say anything else about this anywhere (Hornfans included) until you've spoken to your attorney.
