Homeowners Assoc. nonsense...

My wife and I have lived in our house for less than a year and we're already tired of our homeowner's association.

First, we wanted to revamp the backyard... Add a fence that is no where near any property lines, add a deck, and some rock stairs. We have to get approval for said modifications. Ok fine, I can understand that, don't want to put up an eye sore that pisses off the neighbors. We submit the form in the first week of January. They still have not approved it and we've already went ahead and built everything. We looked at the agreement and in the first revision it said that if the committee fails to approve/disapprove of your proposal within 15 days, the proposal is by default approved. But then in a later revision it was changed to 30 days and by default disapproved. WTF... Is that really fair? It seems its on them to tell us explicitly not to do something on OUR property, not by default we can't alter OUR property... So now the question is what happens if they don't act and by default we're disapproved? Do they have the right to enter our property, walk to the back, and check to see if we made the modifications already? And if they do, what can they do about it?

Second, I've been a lazy *** and haven't taken down our 3 strands of Christmas lights. I haven't had them on, but they have been hanging. They are white strands, white lights, and our brick is white. You barely even see the lights. We get a letter saying that all "holiday decorations must be removed 30 days after the event" and they even provide a nice picture as if we don't already know what they're talking about. First - can't you find something better to do with my homeowners' dues than to drive around the neighborhood, taking pictures, and then mailing me pictures of my own house? Second, how does she know we were celebrating Christmas? We very well may have been celebrating some other "holiday" and it seems shortsighted of them to assume otherwise w/o asking us about it first. In fact, there is a Hindu holiday (I'm Hindu) that is celebrated Jan 14th which would give us until Feb 14th to take the lights down. Not that I was celebrating, but if I were, would I have a legitimate complaint here? Yes I am looking for ways to ***** slap them in the face. Yes I'm petty.
 
okay, your first problem is legitimate. you second one.... no you're just ******* lazy. take down the damn lights.
 
I called them Christmas lights just for descriptions sake. I could of called them Pongal lights but then I would of had to delve into a paragraph long discussion of wtf that is. I don't even really celebrate Christmas, I just like the lights.... And the gifts.
 
1. Welcome to HOA's. I'm content knowing we'll be on 19 acres & can do whatever we want (within EPA guidelines, of course... but if we get a republican in the WH again, count on the EPA being a joke for another 4 years).

2. They are morons for part 1.

3. Take down the lights, you lazy bum. I'll do it for you if you're too busy: $ 35.00 within 20 miles of The Tower.

4. Go right ahead & claim Hindu holiday - they can make your life more miserable than the lights, believe me. Want letters over your trash can being out 10 minutes too long? Someone measuring the height of your grass to let you know it's mowing time? Try to pass off the back yard but you really should do the easy part of taking down the lights.

God why do scams like HOA and mortgage insurance exist.... Sometimes I hate this state.... (though I'm sure every other state is the same....).

If they write you up for having the lights up for another cultural holiday, isn't that grounds for legal action? Something about this screams lawsuit.

Luckily I have a german shepherd roaming around the backyard and frontyard (soon to be 2) which generally keeps people from entering the gate. Unfortunately this includes the chicken **** FedEx guy but the UPS guy is apparently a dog kind of person.
 
It has been a while since I lived in a neighborhood with an HOA, but I think the restrictions only apply to improvements that are visible. So, I guess by putting up a fence, that makes the other improvements to your backyard not visible. With regard to the fence, there should be specific requirements in your deed restrictions regarding what the fence must entail. As long as you have met those restrictions, I think the HOA would be hard pressed to rely on a clause that states the improvement is deemed rejected.

I don't have a problem with them sending a letter about your lights. If that is the biggest issue you have to worry about in your neighborhood, then it sounds like a good neighborhood and the HOA is doing its job. Some low end neighborhoods have to deal with cars up on blocks, refrigerators in the front yard, etc.
 
Believe me, I'm sure the neighbors in my area wish I didn't have the roofing junk in my driveway that I'm overflowing with...

There are 'some' things an association does on the stupid side, but then the back yard is nonsense, provided it doesn't stick up over the fence by too much.

Take down the lights. It's tacky.

When you signed for the house, you signed on to play by their HOA rules. Don't like it? You better sell.

HOA boards tend to attract control freaks and petty people. I wouldn't bother them, they can make your life a living hell.

You might want to show up at a board meeting also. Need to be active.
 
I already admitted I was being lazy by not taking them down... Its the principle of it I was trying to debate...
 
I've never lived in a neighborhood with a HOA so I may be uninformed.....but arent these things laid out ahead of time? Dont you have to sign a contract and what not? I mean it sounds like signing an apartment lease. "I agree to do so and so and not do this and that".
 
You shouldn't have done the construction without getting the HOA to sign off. In my parent's gated community, they've made a number of people tear stuff down after the fact. Lazy on the board's part or not, bad idea.

You can't even defend the lights and you know it, which is why you're now playing the semantics game. The board is in the right and it pisses you off. Take 'em down.
 
I'm with Vibro, the HOA and all of their rules existed when you bought your house. I can say with almost 100% certainty that you were required to sign an acknowledgment of said rules and HOA fees at closing.

I live in a neighborhood that does not allow signs of any kind in your front yard (including for sale or political signs). Guy across the street put up a political sign for his relative running for office and got pissed when HOA told him he had to take it down. Same guy lets his kids leave sh*t all over the yard, in the street and in my yard.

Its not like the rules have changed. Either agree and abide by them or don't buy within that HOA.
 
so a neighbor of mine has small rocks outlining his flower beds in the front and back yards. he decides that he would rather have the white rocks in the front yard and the gray ones in the back yard so he switches them around. gets a letter demanding that he switch them back. apparently you can only have one color of rocks in your front yard or, i don't know, the neighborhood will implode or something. so he calls a lawyer friend who writes a letter to the HOA. HOA does not budge. they are willing to spend everyone's money in court over this issue.

not to mention that in texas, these entities have the right to foreclose on you. so if you piss them off as a group, or piss of a board member neighbor, you could lose your home for something stupid like not paying a $20 fine for having your garbage can out 5 hours too long or leaving your "christmas" lights up a day late.

I already stated I know the rules and that I broke the rules. The point of the post was to ask what happens next and what can they do to me (in regards to point one). Point two wasn't about me being lazy it was more about are they reaching beyond their bounds.... If you just feel like being insulting, take it elsewhere. If you actually have something that may help, please post it.

If the HOA gives you a problem on the backyard work, then get to know the members on the board. Invite them over for a beer and steaks. These things are all political. The HOA members tend to look the other way for their friends.
