Help decide an argument

First time poster...

So my boyfriend and I had a disagreement tonight, I bought a blouse for $70.00 and wore it one time. Off to the dry cleaners. They lost it. The same blouse now (one week later) cost $40.00.

Does the dry cleaners owe me $70.00 or $40.00?

He says $40.00. I get a brand new blouse exactly like the one they lost. I am whole.

I say $70.00. I had to pay $70.00 for it. So should they. The fact that I can get a new one and pocket $30.00 is their problem not mine.

What say you?
 
I say they owe you what you paid, and they also should offer you some free dry cleaning as well.
 
Depends if you have a 40 or 70 dollar receipt. I'm pretty sure they only have to pay for what you can prove.
 
I have a receipt for $70.00 and $40.00.

I already went back and bought it again for $40.00 in case they run out. The question is what SHOULD I ask for?
 
If the same blouse suddenly cost $100, would you still think they only owe you $70? they need to put you right back in the same position you were in before they screwed up- they owe you the cost of a replacement- $40.

I jump on board with the 'replacements'. You paid $70.00 for the original blouse and were happy to do so. Why is it fair to stick the cleaners for the higher price when having the item replaced is your main objective? If you have a beef about the lower price...a week later, take it up with the store.

Texanne is correct in thinking they should offer you some discounts or free cleaning along with the replacement...just from a customer relations standpoint.

Turn the tables. Lets say you borrow a blouse from a friend and ruined it. She paid $100. They are clearing out the same blouse for $30.

I don't think you would fork over $100 bucks willingly with this knowledge.

Now lets say your friend asked for the $100 and you found out the next day she knew they were marked down to $30. How would you feel about the deal.?
 
You should stake out the cleaners or follow all the employees and find out which one stole it when they go to a party.
 
Well here's the deal. This cracks me up. Yes, my boyfriend is a lawyer!! (and a good person) The deal is this....I didn't even know the shirt was on sale and may not have found out if I would have waited to be reimbursed by the cleaners, then gone to the store to get a new shirt. So I asked my boyfriend if that's what what would have happend would you then go back to the cleaners and give them back $30 and he said hell no!! Just thought it would be an interesting topic. Thanks for the input, I'm going to get my $70 bucks!!!
 
As already mentioned, they owe you $40. If they gave you $70, you could buy a new blouse, become completely whole (and then some), and keep the $30.
 
You know at first I thought 70 bucks like the greedy original poster, but now, I gotta agree with the majority. They owe you the exact blouse, new. That's it.


That being said, I probably wouldn't have given them their money back either. Kind of disappointed in original poster, but that's the way the world goes.


Another example, say my brother loses my OJ Simpson rookie card that was worth 100 bucks. Post murder trial, he loses it and he gets the replacement for 50 bucks. Why would he owe me more money?


I guess this is why insurance companies are so shrewd as well. If they weren't people would be taking advantage of them.


I think your blouse is worth less after you wear it as well.
 
Dear boyfriend- listen to orangesuede and run like the wind. Failing to follow this advice is going to cost you a lot.
 
You are now looking for a profit not a replacement. Meaning you would steal if given the opening.

I'll bet you would be hell in a divorce.

I'm going to ask my gf this question. Thanks for the litmus test because if she answers it wrong, she will be gone.
 
what if OP bought original for 70, went in store a week later, sees it at 40, buys, then returns item with original 70 receipt and gets 70 back???
 
I think the retail store only refunds the "sale" amount, not full price in that situation, otherwise they would get "taken to the cleaners"

Don't some retail stores give you a partial refund if an item goes on sale within a certain period. She will get $40.00 from the dry cleaners and MAY get the $30.00 from the clothing store. I agree with an earlier poster. The appropriate party to get the extra $30.00 from, if there is one at all, is the store, not the dry cleaners.

On the other hand, if she didn't know the blouse was now on sale, took the original receipt in and got $70.00. Then a few weeks later went to replace the blouse and realized it was now only $40.00, I'm not sure if I go back to DC and return $30.00. Mostly due to inconvenience and my time spent running around.

Timing is the key here. This scenario could have made one hell of a Seinfeld episode.
