For those who don't know, Laurence Tribe is probably the most authoritative academic on constitutional law in the United States. It doesn't get bigger than him. He's also a liberal Democrat, who generally tows the party line. He's not going to say a Democrat is doing something illegal unless it's such a blowout that he'd be embarrassed not to say it.

Tribe can be bought particularly in a challenge to the EPA. You should look at Whitman v. American Trucking ASSNS., INC. where he challenged the Clean Air Act and lost 9-0.

OK, I may have dabbled in a little hyperbole. It was late at night my time, and and it floored me to read such an article from Tribe. (I had also downed a few German brews if that has any bearing on the matter.) He's usually a reliable advocate for the government when it comes to federal power.
