Dead Tree?

I have a tree in my front yard that still has not produced any leaves on the branches. However, there are small twigs and leaves growing at the base of the trunk. Is this thing dead? What do I do if it is? It's not a huge tree but it's a pretty decent size.

Doesn't soung good, hopefully it's not an oak or you might have Oak Wilt which is nasty and can kill the trees around it.

Sounds like chainsaw time, but you might give it a bit more time, my red oak is still trying to fill out.
