Buying Rosetta Stone software second hand

How can you make sure you are buying someone's copy of Rosetta Stone language software and not a copy (pirated copy)? Should there be a box, written instructions, etc. Is there a way to check with Rosetta Stone to see that you are not pirating a copy when you buy from an individual? Should I just assume that all second hand software is pirated?
 
Philosophically, I believe you have the right to pay any $ amount for a legal version of software, since like a book, you are buying a collected work of "intellectual property."

However, you'll have to look at the End User License Agreement (EULA). The original owner most likely does not have the right to transfer the license. This appears to be the EULA for Rosetta Stone software. Probably a thrilling read.
