Building a fence - neighbor question

One section of fence between me and my neighbor is rotting, due to the fact that the previousl owner of my house let a bunch of vines grow and they have destroyed the fence.

The framing of the fence faces my back yard so my neighbor's side of the yard is probably more aesthetically pleasing.

What I intend to do is leave the existing fence up, but put brand new fencing up on my side - so the framing of both the fences now face one another. From my neighbor's yard you won't even be able to tell a difference - the boards will be the same dimensions, my side will be just newer.

Do I need to get his permission? I intend to pay for everything - I will end up using the same beams to nail the framing into.
 
I'd mention it to the neighbor but not ask. When we had a new fence but up (neighbors tree fell on the old one) we just made it double sided so neither side had to see the posts. Can you do that? It would save money on new posts if the existing posts are strong enough. If you can do that definitely discuss with the neighbor.
