Wouldn't this be easy to avoid? Say Benson gets this installed in his car. Why doesn't he just get a second car (possibly already has multiple cars) and drive that aound? If they make him install one on all his cars, why not go buy a car after everything is installed on his currently owned cars? Or why not just "buy" his mom a car and drive that one? This sounds like it would work on a regular guy but not a guy who made millions last year.

IOn texas, when you get an interlock order, the order goes to DPS usually. there is notation in the system that you msut have one. if you get pulled over and your license run, they can arrest you for driving on invalid license (basically). once that gets back to the judge, you have violated a condition of your bond. they take your bond away, and you remain locked up until trial.

Also, even if the order doesn't go in to the DPS system, a known guy like benson has a lot of people knowing about this order from the media, so he would get caught in a heartbeat.
 
That's good info. Basically he's only allowed to drive a car with a breathalyzer device? He can't drive his mom's car, rent a car, etc?
 
Most likely his license has been suspended and he has been granted a temporary license that stiplulates he must drive a car with an interlock device
 
What a horrible thing to have to put yourself though especially considering how many of you guys claim sooo many false positives happen when you blow into one of those breathalyzers.
 
Since 73 is very familiar with all of this! Either he's a lawyer or a patron of the judicial system.

This is quite common in cases where there are multiple arrests. It is a judge ordered condition of bond that most judges make. It is required in all DWI 2nds, but this is a second DWI first since there are no convictions. The order covers any vehicle that he is driving. The device sucks mainly because of the embarrassment factor – having to explain to anyone in your car why you have an interlock in your car. It is normally calibrated to .03 not .08 and judges get excited if anything shows up. Most people have trouble the next morning not the night of the drinking when they take a cab.

As to the license issues, I would guess that Cedric has an attorney competent enough to request a license hearing with would put off any suspension until a judge orders it suspended. The suspension would also not be enhanced if he had fought the previous suspension as there is not been a recorded previous alcohol related contact. As to the hard suspension, it would depend on what exactly his driving record shows at the time of the filing of an occupational license.
 
guy with that much money doesn't need to drive anywhere.

matter of fact, i don't understand why these guys don't have a full time driver.
 
I have cases where the portable unit is off by as much as .05, compared to a real machine test done 15 minutes later.

.10 at the scene (PBT) and then 15 minutes later or so, guy blows a .05 at the station.
 
You cannot imagine how onerous these devices are, and no, it is not from having one on my own car. Customers bring cars in that have these, and we have to start the cars and test drive them after working on them.
You have to blow on the damn thing real hard to get it to register, to the point of pain, really. Then while you are driving, it starts beeping and you have to blow on it the same way every couple of minutes, it seemed like.
We finally figured out how to disconnect it from the ignition system, which may send a signal to the company, but we have to be able to work on the cars. We called the company the first time to inform them, actually.
Someone like Benson is not going to like putting up with such a device. I don't know if he will try to get around it or not.
Don't get a DWI.
 
He is not allowed to be around alcohol or go to places or functions with it, I assume. If so, haha, he won't get to go to the Heisman celebration. That is if his invite was not already rescended.
