My son got pulled over on the UT campus.. DUI charge. They have the hearing to suspend his license and the arresting officer fails to bring the video so they reschedule.. Is this common or since he failed to show up with the proper defense should the charges have been dropped. Im just curious here. Seems to me it's his responsabilty to be prepared for trail the first time not the second.
 
The hearing to suspend his license is civil in nature and has nothing to to with the criminal case. The best you can do at that hearing is get your license reinstated. Conversely, if you lose at the license hearing and ultimately have the underlying criminal charge dismissed you still don't get your license back. Is this a great state, or what?
 
does your son already have an attorney, or did he represent himself at the hearing?

I would guess the other side asked for a continuance, and it was opposed by your son's lawyer, but the judge granted it.

they really don't need the tape for the ALR hearing anyway. they are automatic. the primary use for them is to get a free run at the unprepared cop, which can be helpful at trial later.

just don't go in to that thing expecting more than a 1% chance of success at that hearing.

*** UTPD are ******* morons when it comes to real crimes, and we have beat a **** ton of their cases.

They are awful.
