Forbidding this woman from voting is a calumny against the Constitution:

A Germantown resident is at the center of a lawsuit filed Tuesday seeking to overturn the state's controversial Voter ID law.

Viviette Applewhite, 93, is the lead plaintiff in a suit filed in Commonwealth Court by the ACLU and the NAACP that challenges the measure's constitutionality (PDF).

The current law, House Bill 934, requires voters to present valid photo identification at the polls during state and federal elections.

That's a problem for Applewhite.

Enough already with this disenfranchisement crap. It insults everyone's intelligence.
 
Mrs. Applewhite is likely to be favorably disposed towards Democrats. But she wasn't the real target of this Republican sponsored voter-Id law. They were concerned that there would be a lot of voter fraud from more nefarious offenders who want to vote for dead people or pretend not to be felons. Keeping Mrs. Applewhite from voting is simply icing on the cake or collateral damage, depending upon your degree of cynicism.
 
For somebody who knows everything, there's quite a bit you don't know/ This is one of several suits filed on behalf of older voters who have no picture IDs and can't obtain picture IDs because many states are not able to produce birth records for "old Negroes".
 
Leftwith: You think Mrs. Applewhite wants to cheat? Is it dishonorable for her to go to court for her right to vote?
 
I would say that if there are legitimate reasons why a person cannot obtain a picture ID for the purposes of voting, then the state needs to make allowances for that, preferably in the way of a voter ID card. And yes, you would have to be able to prove you are who you say you are in some fashion.
 
We just got our renewed 2012 Voter Registration cards in the mail this week. Problem is so did the lady who lived here before us. Technically, Mrs. CEH can go vote twice for the rest of the year. One vote per card. A simple id law to match up the name to the card would prevent that. But whatever, let's not do this in the name of "justice".
 
CEH, there are laws to punish her if she votes twice and by the simple act of putting her signature down when she received a ballot she will provide much of the evidence needed to convict her.
Saying that she has two voter ID cards and could thus vote twice is like saying any gun owner could shoot me. Certainly that would be within the realm of their capabilities as I can't run very fast and present a large target. Fortunately most gun owners are kind, have too small a grievance to actually want me dead and fear the consequences for gunning me down. I don't think anybody on this board wants to confiscate everbody's guns because somebody could potentially use them for dishonorable purpose. I think most voters want a voter ID and to be able to have their say in an election without unreasonable inconvenience. I have no problems meeting the voter ID law. For Mrs. Applewhite, it's more complicated. She deserves sympathy and respect.
 
Yeah i get that. Just sayin maybe the laws on the front end should be as strict as they are on the back end. And i do agree with the above, that the law should be in place with provisions for folks like Mrs Applewhite,.
 
One very important issue that is glossed over in this story is why this lady is having trouble getting a birth certificate. Why can't she get a birth certificate?
 
Does she not receive social security, Medicare or Medicaid? If she does, is there not some proof of citizenship for this?
 
The facts will come out in a court of law. Wouldn't it be ironic if Republican contempt and callouseness towards people in the situation like Mrs. Applewhite will do in the "voter ID" laws they counted on to disqualify a lot of Democrats with a higher "hassle factor" for getting photo IDs.
 
So the people that wanted to disqualify overseas military votes in 2000 are now concerned about disenfranchisement?

Look. I know this issue is entirely political. The Left thinks that voter ID laws will hurt them. The Right thinks voter ID laws will help them. Both sides are disingenuous when they claim moral superiority.

That being said, if you strip the politics out of the issue, there is no reason that people should be allowed to vote without some proper form of identification in a country that requires IDs for cigs, alcohol, cashing checks, buying lottery tickets, claiming prizes, etc... Hell, I have to wear a photo ID just to walk the halls of my school.

PHILADELPHIA (CBS) — Pennsylvania’s new voter ID law requires that, beginning in November of this year, all voters present a photo ID every time they vote (see related story).

But you need to plan ahead, especially if you don’t have a current driver’s license. And you may have to spend some money to get the documents you need.

So, which photo IDs are considered valid?

Ron Ruman, a spokesman for the Pennsylvania Department of State, says photo IDs issued by federal or state governments, and just a few others from approved sources, will be accepted.

“That would include Pennsylvania driver’s licenses or non-license photo IDs, a US passport, a US military ID, (or) a photo ID from an accredited Pennsylvania public or private college,” he says.

Federal, state, or municipal work IDs are also acceptable, as well as photo IDs issued by nursing homes or assisted living facilities.

But, Ruman says, voters should check their state-issued IDs for an expiration date, which is required for the ID to be accepted.

“The driver’s licenses and non-driver photo IDs are valid for voting purposes twelve months after expiration. All other IDs must be current,” he says.

Hurdle For Non-Drivers

A state driver’s license is the most common form of acceptable voter ID, yet when you compare 2010 census numbers to Pennsylvania DMV statistics from the same year, at least a million eligible Pennsylvania voters may not have a license.

“We have issued about 600 of the photo IDs,” said Penndot spokesman Dennis Buterbaugh last week (see related story).

Free Or Pay?

Buterbaugh says the Pennsylvania Department of Transportation will the photo ID without charge to any voter who swears that he or she has no other ID that is acceptable for voting.

“We have a list of things that we ask them, because some photo IDs that people already have will suffice under the letter of the law,” Buterbaugh tells KYW Newsradio. “So we go down the list of acceptable IDs and if they affirm that they don’t have any other IDs, they sign a paper and then the ID is free for them.”

BTW other forms of ID acceptable include
a utility bill
a bank account statement
a government check( I am betting she gets at least one of those)
a photo ID from a senior or assited living center

Sat's article says mrs applewhite's efforts to get a birth certificate have been fruitless . Why didn't she go to the Pa Dept of Transportation which is the org people must go to to get a photo ID if they don't have one.

Assuming all this information is on the up and up, as we all know how the ACLU can and does make a mountain out of a mole hill.

Yea, let's take this one example and just let millions of people that are not qualified to vote.

and that is to get actually vote at a polling place
but as the official for the dept Of Transportation noted they will isse a FREE photo

The NCCAP etc is ginning up a problem where it does not exist.
